Terms of Use

Kascade is a casual word game in which players interact with letter tiles, build words, earn scores, complete game modes, and use optional in-game items and features.

Features, game modes, rules, scoring systems, rewards, and available content may change as the App is updated.

You may use Kascade only if you are legally permitted to use the App under the laws applicable to you.

If you are under the age required to enter into these Terms in your country or region, a parent or legal guardian should review these Terms and provide any required permission.

Ketch Labs Inc. grants you a limited, personal, non-exclusive, non-transferable, revocable license to download and use Kascade for personal, non-commercial entertainment purposes.

This license does not transfer ownership of Kascade or any of its content to you.

You may not:

• Copy, modify, distribute, sell, or commercially exploit the App or its content except where permitted by law
• Reverse engineer or attempt to extract the source code of the App except where applicable law expressly permits it
• Use cheats, exploits, automation, bots, or unauthorized software to manipulate gameplay
• Attempt to interfere with the operation or security of the App
• Manipulate scores, rewards, purchases, leaderboards, or other game systems
• Use Kascade for unlawful purposes

Kascade may include virtual items such as coins, boosters, power-ups, or other digital game content.

Virtual items:

• Have no real-world monetary value
• Cannot be exchanged for cash
• Cannot be transferred outside Kascade unless the App specifically provides such functionality
• Are licensed for use within the App and are not your personal property

We may adjust the availability, functionality, pricing, rewards, or balance of virtual items when reasonably necessary to operate, balance, or improve the game.

Kascade may offer optional in-app purchases, including consumable virtual items such as coins and boosters.

Purchases are processed by the platform through which you obtained Kascade, such as the Apple App Store or Google Play.

Prices and applicable taxes may vary by country, region, currency, and platform.

Purchases are subject to the payment, refund, and other applicable terms of the platform that processes the transaction.

Consumable items may be depleted when used and generally cannot be restored in the same way as non-consumable purchases.

Except where required by law or provided by the applicable app-store platform, purchases are final and non-refundable.

Kascade may display advertisements.

Some advertisements may be optional rewarded ads. If you choose to watch an eligible rewarded advertisement, you may receive an in-game reward after the required advertisement conditions have been completed.

The availability, type, and amount of rewards may change.

We do not guarantee that rewarded advertisements will always be available. Availability may depend on factors such as your region, device, internet connection, advertising provider, and available advertising inventory.

Kascade may record gameplay information such as scores, completed games, achievements, statistics, rankings, or leaderboard positions.

We may correct, remove, or invalidate scores, rankings, rewards, or gameplay results when we reasonably determine that they resulted from cheating, exploitation, technical errors, manipulation, or other violations of these Terms.

Leaderboards and rankings may change as other players participate and as ranking systems are updated.

We do not guarantee that gameplay progress, scores, rankings, or statistics will be permanently available.

Some Kascade gameplay data may be stored locally on your device.

Deleting Kascade, clearing its data, changing devices, or losing access to your device may result in the loss of locally stored progress, virtual items, settings, or other game information.

Where cloud-based features are available, additional recovery options may be provided, but we do not guarantee that all gameplay data can always be recovered.

We may update Kascade from time to time to introduce new features, game modes, content, balance changes, bug fixes, security improvements, or other modifications.

We may add, modify, suspend, or discontinue features when reasonably necessary for the operation or development of the App.

Certain features may require an internet connection or a newer version of Kascade.

Kascade and its original content, including its software, graphics, user interface, designs, game mechanics as protected by applicable law, branding, logos, sounds, text, and other materials, are owned by or licensed to Ketch Labs Inc.

All applicable intellectual property rights are reserved.

“Kascade,” the Kascade logo, and associated branding may not be used in a manner that suggests endorsement, affiliation, or authorization without permission from Ketch Labs Inc.

Kascade may rely on third-party services for features such as advertising, in-app purchases, analytics, hosting, or other functionality.

Your use of those services may also be subject to the respective provider’s terms and privacy policies.

Ketch Labs Inc. is not responsible for third-party services to the extent permitted by applicable law.

We aim to keep Kascade available and functioning properly, but we do not guarantee uninterrupted or error-free operation.

The App may occasionally be unavailable because of maintenance, updates, technical problems, network conditions, third-party service interruptions, or circumstances outside our reasonable control.

Kascade is provided on an “as is” and “as available” basis to the extent permitted by applicable law.

We do not guarantee that the App will always be available, error-free, secure, or compatible with every device.

Nothing in these Terms excludes warranties, guarantees, or other rights that cannot legally be excluded under applicable consumer protection laws.

To the maximum extent permitted by applicable law, Ketch Labs Inc. will not be liable for indirect, incidental, special, consequential, or similar damages arising from your use of or inability to use Kascade.

Nothing in these Terms limits or excludes liability where doing so would be prohibited by applicable law.

We may restrict or terminate access to Kascade or particular online features if a user materially violates these Terms, abuses the App, manipulates gameplay systems, interferes with services, or engages in fraudulent or unlawful activity.

You may stop using Kascade at any time by uninstalling the App.

Your use of Kascade is also subject to the Kascade Privacy Policy, which explains how information may be collected, used, stored, and processed in connection with the App.

These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada, without regard to conflict-of-law principles.

Nothing in these Terms prevents you from benefiting from mandatory consumer protection rights that apply to you under the laws of your country or region.

We may update these Terms to reflect changes to Kascade, our business practices, applicable laws, or third-party requirements.

When these Terms are updated, the “Last updated” date at the top of this page will be revised.

Your continued use of Kascade after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
